Spryng Gifting Service Agreement

The NJBEST/Franklin Templeton Investments 529 College Gifting Program (the “Program”) is a service provided by Franklin Templeton Investments (“FTI”) that allows an owner (“529 Account Owner”) of an NJBEST or Franklin Templeton 529 College Savings Account (“529 Account”) to create an online profile of the Account’s designated beneficiary and to share that information and/or a hyperlink to it with family, friends, and other invitees for the purposes of inviting contributions to the Account (“Gifts”).

Prior to making a Gift to a 529 Account, please review the online Frequently Asked Questions (“FAQs”) Section available on the Program website for more information regarding the Program, including important details about making a Gift.

By clicking “Agree” below, you acknowledge and agree that:

  1. You intend to make a Gift to a designated Account, and understand that once you make your Gift it will be considered a completed Gift. Because the Gift will be property of the 529 Account Owner, FTI can neither return the Gift nor assist you with the return of the Gift.
  2. Although 529 plans are designed as college savings plans and are meant to help pay for college or other higher education, the 529 Account Owner controls the 529 Account and may make withdrawals and use the amounts in the 529 Account, including the proceeds of your Gift, for other purposes. The Account Owner would be subject to income taxes on the earnings portion of any such non-qualified withdrawals and, with limited exceptions, an additional 10% federal penalty tax. In addition, a 529 Account Owner may also change the designated beneficiary of the 529 Account to a different beneficiary. Please see the Investor Handbook for more information.
  3. You understand that your Gift is considered a completed gift to the designated beneficiary of the 529 Account, and may subject you to gift tax, generation skipping transfer tax or other tax consequences, and that you alone are responsible for any such consequences and the payment of any resulting taxes.
  4. When using an e-check, or electronic check, to make your Gift, all information you submit in connection with your Gift, including your bank routing number and account number, is accurate and truthful, and you are responsible for the accuracy of any information.
